I am from Maharashtra. Was riding my motorcycle from MH to KA. And in KA on a state highway without dividers, out of nowhere a guy on a bike decides to cross the road right in front of me. The only thing I remember next is i shouldn’t hit him head on so i swerved to the right to avoid him. When I get up from the crash, I am mostly okay except a fracture on my finger. Thanks to my riding gear. And then I see a lady crying on the side. Apparently my bike hit her and I don’t remember anything but certainly looked that way.

Lady’s both legs got multiple fractures and estimated surgery cost around 6-10L

Mistake 1: I called my third-party insurance toll free number and they said third party doesn’t cover injury to a person. And i believed it.

Mistake 2: i only informed 1 friend about this and thought to not give trouble to family members at that very moment as they would panic, etc. I then proceeded to pay 7.4L through online transfers to the third party folks as I wanted to escape the terrible situation asap and also because my fractured finger needed attention too and that KA village has nothing good around in terms of hospitals. And I also felt somehow responsible because my bike hit her although I knew i didn’t make any mistake.

Mistake 3: In those panicky moments, didn’t bother to find out who that bike guy who jumped in the middle was.

Anyways, the lady’s family were very nice to me, etc. We made an agreement at some nearby computer typing shop which stated that I had the accident due to one guy and that the lady suffered leg injuries and that I would bear the treatment expenses. Showed this to police station so they let me go.

Fast-forward 2 weeks and I come to know she completed the leg surgery but suffered cardiac arrest on discharge and then was put on ventilator (lady ‘s family had told me earlier that she was a cardiac patient). The family then asks me for extra 4L for ventilator cost. I tell them to claim third-party insurance since I now know third party covers unlimited value for person injury. So they go ahead and file FIR and then I send my bike by transport to KA again for their mandatory rto inspection. They have till date not released my bike citing to get court order.

Fast-forward 3 months and she passes away.

Police say they will update the FIR and call me to police station for a statement. It’s been 2 months since and no update from police station. Anyways, my POA attorney is in touch with police for further details.

Question 1: During the criminal court case, should i plead guilty even if I know I didn’t commit any mistake? Some lawyers say this is better because I then just need to pay a fine and the criminal case is closed, and then I don’t need to go to court again and no endless draining of money for trial, etc. But some lawyers say that it will be a permanent blip in my record.

Question 2: I work in IT. Will this cause any issues in background verification on job switches? Will passport renewal be a problem? Any tourist visas like schengen will be tougher to get?

Question 3: If I decide to plead not guilty, what are the chances that I am acquitted? How much money or hassle of lawyer, etc would it be to endure all this? How long will this criminal case last? Especially since I stay in MH and the court case will happen in some small town in KA

        TLDR:

Met with an accident. FIR against me. Need recommendations on ways forward.
