April 25, 2025 at 6:20 pmI enrolled in a pilot program with a major airline in India. I paid โน2.6 lakhs for ground training (which I completed) and a $2000 deposit when I joined the company. This deposit was sent to a flight school in the US where I was supposed to train later once I made the first payment after ground training and going to the US.Due to a family financial crisis completely outside my control (my parents used my savings without my knowledge for their business which went bankrupt), I was unable to continue the program. I never began the actual flight training or traveled to the US.
The HR representative told me they would initiate termination procedures since I can’t secure funding.
I have no assets, my parents have poor credit history (currently having 2-3 crore worth of loans), I can’t secure a loan on my own as I’m young with no job history, and relatives have completely cut us off. Banks won’t give me a loan for pilot training without collateral since it’s not a STEM course. I’ve explored all possible avenues.
I’ve learned that other students who paid the first payment (~$38,000) but were terminated for not passing exams in the given time limit (failing 2-4 times) received refunds of approximately $40,000 (their $38k payment plus the initial $2k deposit).
The $2000 was essentially a “safety top-up” for training I never received (fuel, extra classes if needed, or any extra exams which exceed the first payment, like a minimum balance which need to be maintained), but the contract also says it’s non-refundable
But the flight school also said if any balance is left after the training like after all the instalments, and we use less amount than required, like completing training early, less exams, less training sessions, less months spent = less money then they would refund anything extra which is left (instalments + the deposit). However, I’m not part of the program anymore.
Questions:
1. **Rights to a refund?** The deposit may have been labeled “non-refundable,” but since no services were actually used and the airline has set a precedent by refunding other terminated students, do I have legal standing?
2. I sent an email to HR and the training in-charge after termination. I also contacted the US flight school directly when they asked for an update regarding the first payment.
3. The company has looped the email asking for action but there’s been no reply from either the company for 5 days or flight school for 10+ days.$2000 would make a significant difference in my current financial situation as I literally have only 1 lakh rupees left in my account and no support from my parents.
I’ve already sent emails explaining my circumstances and requesting the refund, but haven’t received a definitive answer yet. They did not deny my refund but no replied and I’m in a loop
Any advice on how to proceed would be greatly appreciated.
