February 9, 2025 at 11:41 amI was met with an accident yesterday in Bangalore. While crossing my green signal, a bike rider sped in front from my car (while breaking his red signal) was hit by my car. He fell to the ground but quickly got up and moved his bike to the service road. My car has major bumper and front end damage. I moved behind him and went out to check up on him and talk to him. He kept saying my bike is not starting let me see first. He was in the wrong and I told him everything is recorded in my dashcam. Before I could speak anything about insurance or compensation, he started his bike and fled. It all happened quickly. I don’t have his details. (My mistake)I then went to the nearest traffic police station and showed everything in video along with the damage. The cops saw that it was his fault and suggested I come tomorrow and they’ll try to speak to him for outside settlement. I went today and the person didn’t answer. The cops are saying two options:
File an FIR and go through court (my car will be kept for inspection) or take NOC, go though my insurance AND they’ll lodge a penalty on this person’s license. What should be the best course of action? Should I do the FIR? Is there any way to speak to this person (as I know the legal route can be pretty long)
If I file an FIR what happens then?

February 9, 2025 at 11:56 amLawyer in Bangalore here. If you want the bikerβs insurance to pay for your damage, and you want your car with you, go for the second option -

this happened with me once, i check with the insurance agent/service centre guys, what would be the cost of this service and extra that I would have to pay for next premium (No claim bonus). extra amount that i might pay +20% extra(for additional work etc.) asked from the guy who hit my car, and for not filling FIR.
