April 20, 2025 at 8:37 pmI purchased a villa plot in a decade-old Kerala development, initially marketed as ready-built homes but later rebranded as plots. The project only received RERA registration recently. Out of 100 plots, only 20 homes are constructed including mine.The builder now claims that the project is complete and is pushing for society formation, while also issuing hefty maintenance bills and threatening to withdraw from all services like water and electricity, secuirty other maintenance activites from May — despite points mentioned in the sale deed being incomplete.
A major roadblock to forming a society is the lack of transparency. While the builder claims 50% of the plots are sold, there’s no formal record or communication about who these owners are. This makes it difficult to achieve quorum or shared consensus for society registration, especially when the builder is trying to shift all maintenance responsibilities without fulfilling their scope.
We’ve formed an informal residents’ group and filed complaints with Kerala RERA. However, our complaints were repeatedly rejected on filing grounds, and during that time, the builder managed to get the project registered. RERA has so far appeared biased being overly critical of our submissions while not addressing any of the builder’s lapses, even in hearings where the builder was present.
While the hearing with K-Rera is set for July we are tryong to get the heraing preponed. But with the intimidation ta tics deployed by the builders. Is there anything that can be done?
Has anyone faced similar challenges with RERA proceedings or builder disputes in Kerala? Any advice on effective strategies would be greatly appreciated.
