January 29, 2025 at 11:51 amThe father would obviously be the biological father. But the problem here occurs when whose surname should a baby inherit that was born out of paternal fraud. That will be the basis of the child’s surname going into school, getting PAN card, Aadhaar card, Passport, etc.-

January 29, 2025 at 12:30 pmFirstly my dear sir, you are mixing up an ethical question with a legal question. The legal position as per the law is that a child born during a valid marriage is presumed to be the legitimate offspring of parents who had access to each other at the time of conception.Secondly my limited point was that in all official documents a father’s name is mandatory as per the officials even though there are notifications saying differently. Therefore a woman must argue at every juncture to retain that right. The comment to which I responded had said that such mothers must keep only their name and not include the father.

January 30, 2025 at 5:06 amMy dear sir, this has nothing to do with the woman and everything to do with bureaucracy. The point is about the inability of the system to not ask for the father’s name. Also the consequences are for the child not the mother and the child is blameless in the matter
