AThats the state of Indian laws…Why can’t wife take responsibility of her mistake and become the legal guardian.

PThe father would obviously be the biological father. But the problem here occurs when whose surname should a baby inherit that was born out of paternal fraud. That will be the basis of the child’s surname going into school, getting PAN card, Aadhaar card, Passport, etc.

SFirstly my dear sir, you are mixing up an ethical question with a legal question. The legal position as per the law is that a child born during a valid marriage is presumed to be the legitimate offspring of parents who had access to each other at the time of conception.
Secondly my limited point was that in all official documents a father’s name is mandatory as per the officials even though there are notifications saying differently. Therefore a woman must argue at every juncture to retain that right. The comment to which I responded had said that such mothers must keep only their name and not include the father.

UWell you have to pay the piper. Nobody forced her to go out of her way and cheat. Shes an adult and adults face consequences for their actions
