I recently had a bad experience with a company and want to send a legal notice to address the issue. Specifically, I was overcharged for a service, misled by the staff, and also experienced a privacy violation when they sent me someone elseโ€™s invoice with their personal details.

I have drafted a legal notice outlining the incident, my demands (a refund, compensation, and an apology), and a 15-day deadline for resolution. I also included a statement clarifying that my demands are lawful and made in good faith, not intended as coercion or blackmail.

        Hereโ€™s my question:

        1. Can I send this legal notice directly to the companyโ€™s nodal officer via email or registered post?

        2. Will this be considered a formal step before escalating the issue to the Consumer Forum?

        3. Is it necessary to involve a lawyer at this stage, or is a self-drafted notice valid for such cases?

Iโ€™d appreciate any insights or experiences you can share. Thank you!

          Lawyer here.

          Answers to your questions:

          1. Yes.

          2. Yes. But is is not necessary.

          3. You should not be drafting legal notices and claims on your own. You will inevitably fuck up and ruing your case.

I would advise that you go to a good lawyer if you want to make a claim that is worthwhile.

Please run your notice through a spell check once.
