January 23, 2025 at 4:53 amInsurance against Home Loan of my Late Uncle has been rejected. I wanted to know what are the legal options i have to get the claim processed and what are the implications in certain situations or should i straight away approach an Insurance Lawyer (I don’t know how to connect with one either). I have a few basic questions, Hope anyone could help me understand what are the options i have. -

January 23, 2025 at 10:22 pmMy Uncle Passed away due to sudden cardiac arrest and he had a Home Loan running.He had an Insurance against that Home Loan and after submitting the Claim documents we were told that the Claim has been repudiated due to non disclosure of his past medical history.
He went through Mouth Cancer surgery in 2021 and took the Loan through a Balance Transfer from another bank in 2022. While availing the Loan there was no way he could’ve hide his medical history from the insurance agents as there were visible physical changes and we are confident he made all the disclosures.
The Insurance company also didn’t do a Medical CheckUp while issuing the Insurance.
We believe that the agent in order for the policy to be approved, Might have hidden my Uncle’s medical history.
What are the options we have to resolve this claim and settle this dispute and get the money from the Insurance company?
My Aunt is a Housewife and both their children are minors. They do not have any means to pay this home loan apart from the insurance.

April 6, 2025 at 2:28 pmFrom the history you are saying, it is highly likely that his health history was hidden. While you may blame the agent, your uncle would have signed the insurance form. If he signed on a blank form or where the existing health issues were mentioned as None, be rest assured that even if you go to courts, the claim would be rejected. While I empathise with the family background, this ignorance may cost them badly.It is sad to see that agents do this for fulfilling their targets. We specialise in such insurances and we ensure the disclosures are to the last level. It often irritates our clients. At times the policy application gets rejected. At times with higher premium. But we then are at peace that now the insurers have no way to reject.
