January 25, 2025 at 5:30 amOver the past two years, my maternal aunt (38) has been harassing and physically abusing my grandparents. Even before this escalation, she had always behaved rudely toward them, but now, as their health has deteriorated, the abuse has intensified. My grandmother, in particular, has suffered greatly. After enduring repeated beatings, she has lost her sense of self, often failing to recognize anyone. She constantly relives painful memories from her youth and screams in agony over them. Despite this, my aunt continues to beat her with sticks and other objects.Whenever such incidents occur, my uncle simply leaves for the village, avoiding confrontation. My mother has consistently urged my grandmother to come live with us, but she always refuses, saying she has already burdened my mother enough.
Yesterday, we received a call from neighbors informing us that my grandparents were crying. My mother, deeply concerned, went straight to their house from her workplace and called her sisters for support. Together, they decided to involve the police. However, when the authorities arrived, my aunt began cursing and threatening all of us, wishing for our suffering and even death. She escalated matters by filing a false FIR against my mother and father, accusing them and my grandparents of harassment and dowry demands.
This put my mother in a difficult position, as she works in a government department and is the sole breadwinner of our family. Fearing for her career and our family’s stability, she had no choice but to compromise and get herself out from the situation.
Over the years, my mother has sent substantial financial support to my grandparents, totaling around 5β6 lakh rupees. She never expected this money back, as it was intended to cover my grandparents’ medical expenses, except for a specific sum she gave my uncle for house repairs.
We learned it two years back that my grandfather who owned about 30 acres of inherited farming land, had already been handed over to my uncle without informing my mother or her sisters. But she didn’t want a share of anything, Just so you know that my Grandfather never gave dowry, My mother got married without it. So she never took a single penny from them.
Now, my mother and her sisters are determined to claim their rightful share of the property. They want to ensure the land is divided fairly among them and that my aunt and uncle do not benefit further from it. Also, Is my mother at risk if she puts a dowry and harassment case against my mother??

Get alwayers and take your grandparents to file physical and mental harrasment case against the aunt.Generally Mental and physical harassment of senior citizens is considered above domestic violence by the courts.

January 25, 2025 at 8:59 amThat’s untrue. A senior citizen who has a fake 498a complain against him/her, can be jailed. There are so many instances where 80 year old father’s have been jailed after a fake Domestic Violence under 498a was filed against them. The more backward the state you reside in, the worse treatment innocent people get afte fake FIRs.

What’s should we do as a family.-

January 25, 2025 at 5:56 amSenior Citizen Act helps needy grandparents. The procedure is simple too and application lies before Tahasil/ Collector. Get a good lawyer and ask them to file an application explaining your situation. The procedure is fast tract therefore within a few months 6-9 months the application is decided. Your grandparents can ask for maintenance, protection and possession of property (if documents are in place).
To support your case you can file FIR/ non cognisable complaints too. -

January 25, 2025 at 7:06 amFirst, convicne the grandparents to move in with you. They are adamat but tell them eithet they move or die at the habds of their greedy bxxch. Elderly abuse case, please file and it will get priority ASAP. Also, you need to inform local police station too. Keep them informed everytime such an incident occurs. -

January 25, 2025 at 8:07 amStarts recording your aunt for evidence.. and start collecting evidence on WhatsApp, chat or messaging, call record, any documents anything that can be proven in court..this will be a long process but be patient and keep all record…even take pics of grandparents body marks to prove she beats them.. then go for senior citizens act…. Don’t rush for anything fast. -

January 25, 2025 at 9:34 amLawyer from HyderabadYou have to approach the high court to file a quash petition against that False FIR and ask your grandparent to approach senior Citizen tribunal for recovery of the property for they maintenance and protection from your aunt.
