        Hi everyone,

        I’m seeking legal guidance regarding a land sale deal that has gone wrong, and weโ€™re especially concerned because the buyer has political influence.

        Background:

        – We own an ancestral commercial land valued around โ‚น10 Crores.

        – Two years ago, we entered into an agreement with a buyer who is a benami for a lawyer-cum-politician. (the guy is a state level leader of a non-ruling party)

        – We received โ‚น15 lakhs as advance and signed a sale agreement on โ‚น20 stamp paper (not registered or notarized).

        – Since then, the buyer has continuously delayed the sale process. No registration, no further payment.

        – Now, after two years, weโ€™ve decided not to sell the land at all. However, the buyer is insisting he will complete the deal after one more month.

        – We are not interested and are ready to return the โ‚น15 lakh advance to get out of this completely.

        Issues:

        – The agreement is unregistered, so legally, we believe itโ€™s not enforceable under Indian property law.

        – However, the buyer is politically connected, and weโ€™re concerned about pressure, harassment, or misuse of influence.

        – We want to end the matter cleanly and legally, but also want to be prepared in case the buyer tries to create trouble.

        Questions:

        1. What legal steps can we take to cancel the agreement and return the money?

        2. Is the buyer likely to have any enforceable rights with just an unregistered agreement?

        3. Can we serve a legal notice and proceed to resell the land safely?

        4. How do we protect ourselves from potential political intimidation or misuse of power?

        Would really appreciate any advice or insights from lawyers or anyone with experience in similar situations.

          NAL- Unless a timeline is specified in the agreement it is valid upto three years
