        Hi everyone,

I’m in a bit of a bind and need some guidance. I fell victim to online money fraud and immediately filed a complaint with the Cyber Cell. They acted fast and froze the culprit’s bank account. Within 2-3 months, I received a District Court verdict ordering the bank to return my money.

The process, as explained to me, is that I must present a copy of the court order at the Cyber Cell, and they will then mail the bank (where the culprit’s account is held) to reverse the transaction. The court clearly stated that the refund should be processed within 10 days of the bank receiving this mail.

However, it’s now been about 8-10 months since the Cyber Cell first sent the mail, and I haven’t seen any refund or even a response from the bank. Every time I visit the Cyber Cell, they simply tell me to come back every 7-10 days so they can send another reminder, claiming that after 3-4 reminders, the bank will “surely” act on it. Frankly, I’m losing hope as it feels like no one is taking my issue seriously.

Has anyone experienced a similar situation or have any advice on how to expedite this process? Is there any legal recourse to ensure the bank complies with the court order, or any other steps I should consider taking? Any guidance or suggestions would be greatly appreciated.

Thanks in advance for your help!

I think Bank can mostly lien mark the account for disputed amount, they would still need consent from the account holder to withdraw any money. Unless there is some very serious charges like money laundering etc, banks rely on consent from account holder, these orders from district court may not be a big help.

You’ll have to file an execution petition

                    Lawyer here:

Ideally, you have to go for an execution petition.

But, you can also file a complaint with the Ombudsman (can be done on your own, online, no hassle). They are actually efficient.

You have to file a simple Application for the compliance of that order through an Advocat. Contact me for filing the Application.
