        My brother in law and his wife asked me to buy a land together and we did. The witness was my husband from my side and their son from their side.
        I paid almost 60 percent of the total amount at the time of purchase and was promised the amount of land equivalent to it but now that I see the registry papers it says 1/3rd portion in equal.
        I am left in total state of shock.
        My question is why was I not asked to be present at the time of registration.
        I did sign the papers trusting my husband during the deal but was not informed about anything anywhere else.
        Is this legal. Is there anything I can do against them. Do I have any hope. Thanks

          Have you asked your husband? He might have used part of the payment to settle his personal debt with BIL.

          Who is registered holder of balance 2/3 ownership?

              My husband is saying he doesn’t know how this happened. I don’t want to disclose too much but me and my husband trusted my brother in law because he himself is an advocate.
              The other 2/3 is with my brother in law and his wife.

                  I am assuming that it was 60% on the paper that your husband read and asked you to sign. Have you kept a copy of that doco? If yes, you can confront BIL.

                  If you have signed paper accepting 1/3 ownership then you can’t do much.

                  If you have paid cash then claim of 60% paid by you won’t be legally tenable.

                  Best option would be for your husband and you ti discuss this with BIL to understand his game.

                  BIL being a lawyer, paper manipulation and fraud can’t be ruled out.

                      Hi, thanks.

                      We both totally blind trusted him. Ashamed to say that we didn’t read because everything happened too quick that day. 

                      I did pay by cheque and the registry mentions my amount but also the fact that land is to be divided equally in three.  

                      Is there anyway to seek help on this. He has blocked us. We do plan to visit him but meanwhile I am just feeling very confused and betrayed honestly.

                          In my view, It will be difficult to get back what is rightfully yours unless BIL decides to work with you and revise the registry.

                          But you can file for a fraud FIR claiming manipulation by BIL. But that will complicate family/social scenario and your 1/3 ownership will get stuck in litigation as well.

                              I think the family and social scenario has already been screwed up by the BIL. If you want what is rightfully yours, first would be to have a calm discussion and understand his part of the story.

                              In case he is unapologetic and not planning to make any amends, you already have your answer. You have come here for legal remedy, so you do want what’s yours. What are the options you are looking at ?

                              1. For the amount you paid commensurate land
                              2. Refund of money that you paid over and above your 1/3rd share.

                              Second option might be easier unless you feel you would like the first option.

                              Accordingly, always preferable to have family matters sorted with talks first.
                              But let me tell you, generally they don’t get resolved much with the talking.
                              There is legal remedies to help since you have paid money through bank

                              Has the cheque been encashed? If not, you can try stop payment of cheque. This will sour the relations though

                        Don’t worry. You can file a suit for declaration that you own the property to the extent of your payment. Rest take proper legal advice from a competent lawyer. I can suggest you if needed.

                              Hi lawyer from delhi here!

                              You can still challenge the registry on the following grounds to dispute its accuracy, such as fraud, forgery, undue influence, or if there was a mistake in the registration process; however, the challenge must be made within a specific time frame and usually requires filing a civil lawsuit to rectify the issue. 

                              Don’t delay in filing the respective cases.
