March 13, 2025 at 3:28 amI have tried to keep it as short as I could. The reason I’m asking it here is as I feel our lawyer is probably not taking things seriously.purchased a piece of property in a private pond owned by a specific family. I now know how the land registration must have been done, where there was no land , they are like 10-12 relatives who live beside each other and hate each other , there seems to be no 100% clarity on ownership of the pond.
Few years later , we began filling part of the pond but few days later , govt passed an order that water bodies cant be filled, so we stopped mid way.
One of the relatives whose house is beside the part we filled started extending his house on the filled area, now initially police didn’t help us as his son in law is a high rank police official(this is an assumption based on police not coming inspite of a prior notice and several calls ),
we’ve had several confrontations with him. We’ve managed to halt his construction, but the case has been ongoing for 10 years, and the other party has skipped court twice in the High court. It is now exhausting and we don’t want to continue with it at all.Here are my questions:
1. Is it possible to cancel the land registration and get our money back from the seller, bought like 15 years back, considering the land didn’t exist at all as it was a pond ? Or the onus is on us ?
2. How long can the other party keep skipping court dates ?3. What’s our best option for peace of mind and possibly recovering our money?

March 13, 2025 at 4:11 amIt was bought decades ago , also as it was a private pond , everyone did what they wished, they used to fill it up and construct their house.So it was probably bought, in consideration that it would be filled .

March 13, 2025 at 5:50 amNALConsult a different lawyer who specialises in RERA cases. Also, as per the post, you’re the owner of that property. Registration and all formalities done. Is that correct?
If the property is already in your name, there’s no one to blame here unless it was illegal to sell such properties at the time of sale. It even got registered so I assume it was not illegal at the time of sale.
I’m looking at it like this – I bought a land 15 years ago, I’d the option to build a house on it or sell it, I did neither for xyz reasons and now I demand a refund from the seller who sold it 15 years ago. There’s a very slim chance of winning this. Your lawyer probably already knows this but he’s still doing it cuz he’s getting paid.
