So one of my friends work at a CA firm(pretty decent size and considered one of the best in the city and country as a whole) and she has completed her 1 year of articleship in that firm. After clearing CA intermediate exams, every student is required to do a mandatory 2 years of training, it can either be 2 years of articleship or one year of articleship and one year of industrial training in any company.
She received a very good offer from one of the leading FMCG companies for industrial training so she spoke to the CA firm’s HR and her manager regarding this and they told her that if she wants to leave the firm she has to pay back whatever extra was given to her as stipend above the minimum prescribed limit set by ICAI ie 4k per month and she got 12k per month, so she has to return back the extra 8k for all months.
What can she do here? Is there any law that prevents the firm from taking back the stipend from an Article?
