Title, I was looking at a sample sample of Technitium, this element is a weak beta emitter(which is safe amount if stored in a glass vial). Then I started wondering if it islegal if it’s completely safe and impossible to misuse??

          – The Atomic Energy Act, 1962 or the Atomic Energy (Radiation Protection) Rules, 2004, doesn’t permit the general public to purchase or possess radioactive materials without specific authorization.

          – Handling or purchasing radioactive materials in India requires a license or registration from the Atomic Energy Regulatory Board (AERB).

          – If you have a legitimate need for radioactive materials (e.g., for research or industrial purposes), you need to submit an application to the AERB. This application requires details about the intended use, availability of safe storage, qualified personnel, etc. AERB will inspect the installation site and issue “No Objection Certificate (NOC)” for procurement of radioactive materials.

In India, buying or possessing even small amounts of radioactive materials like Technetium (or Technetium-99m, its metastable isotope) is tightly regulated under national laws, regardless of the amount or intended use.

Radioactive substances in India are governed by the following laws and authorities:

                The Atomic Energy Act, 1962

Atomic Energy (Radiation Protection) Rules, 2004

Atomic Energy Regulatory Board (AERB) โ€“ the central regulatory authority overseeing the use, possession, transport, and disposal of radioactive substances.

**Is It Legal to Buy a Few Milligrams for Personal Use?**

No, it is not legal for a private individual to purchase, own, or import radioactive substances without a license from the AERBโ€”even in tiny, “safe” quantities.

Even weak beta emitters (like Technetium) are considered controlled substances.

                **Licensing Requirements**

To legally acquire or handle radioactive materials in India, you must:

Be part of a licensed medical, research, or industrial organization

Obtain prior permission from the AERB

Comply with radiation safety standards, including storage, shielding, disposal, and personnel protection

                **Technetium-99m Specifically**

This isotope is commonly used in medical imaging (nuclear medicine) and is only supplied to licensed hospitals and diagnostic labs with radiation safety officers (RSOs) and approved infrastructure.

While your scientific interest is understandable, even safe-seeming radioactive samples are not legally permitted for personal or hobbyist use in India. Thereโ€™s no exemption for โ€œsmallโ€ or โ€œnon-dangerousโ€ quantities.

There are already some Radioactive materials which are present in our house like in smoke detector Americium is used, in the old gas burning lanterns Thorium is used, and if you are able to extract these metals from these two components and enrich them, then if you are able to get some pure radium some how you have 80% components which is required to make a nuclear reactor, you just need to go to Google scholar or Research gate and read about creating a nuclear reactor with these things.

Umm Radium and Americium can be used to make a neutron gun, and if the neutron particle is projected towards the enrich Uranium or Thorium then the chain reaction will start but at this point you have to make sure that the reactor is in control or it can become an uncontrolled nuclear bomb which will be sufficient enough to wipe out a small city, And don’t worry about the police in this case since in India we don’t have Gieger Counter installed in every city of the country, Gieger Counter is a device which is used to detect the Radiation without it no one can catch you but anyways. There is a book which is disconnected from the Market which is The Golden Book of Chemistry in it there are a lot of experiments that the book was used to publish during old time so it doesn’t have much safety precautions, there is also an experiment in the book which tells about how to make nitro glycerine at home, if you don’t know about nitro glycerine it is the chemical which is used to make Dynamite. Alfred Noble was the person who discovered it, later on he started and formed a Team who gives Noble prize from the fortune he made by selling Dinamite. There are also a bunch of things to say but anyways.

As per my best guess I donโ€™t think so these things re heavily controlled.

buy a bunch of old radium watches, extract radium from it. Profit.
