May 3, 2025 at 3:55 pmI am reaching out to seek legal advice and assistance regarding child support. I am not from India, but my ex-boyfriend who is an Indian citizen is the father of my 5-year-old daughter. He is not consistently helping me in raising or supporting our child financially. I would like to know the legal steps I can take to make him contribute monthly to our daughter’s support, especially considering that he lives in India and I do not.
I would appreciate your guidance on whether I can file a case in India, what documents or evidence I would need, and what the process would look like.

May 3, 2025 at 4:11 pmOn legality, yes, you can seek child support. Realistically, be prepared for a looooomg drawn out legal case, which is only complicated by the fact that you’re not in India :/ -

May 3, 2025 at 4:13 pmYour child is entitled to maintenance and inheritance irrespective of whether you both are married or not and both parents are obligated to provide financial support to the child. You can claim child support and can use DNA test as proofAmount of money received from the child support would depend on your bf’s income and financial status
(note: Though your baby is entitled to maintenance, he is not entitled to the property of your bf unless the property is ancestral or your bf passway without a will)

May 4, 2025 at 3:48 amThats wrong. Child has inheritance rights on his/parents assets. Indian law always considers the best interest of the child in such cases.-

May 4, 2025 at 6:40 amNo, if the property is self acquired by the father then he can make will without consideration of the child. If the property is ancestral then the father’s will is void

May 3, 2025 at 4:19 pmName and shame him . I am sorry to have to say this and this is probably not what you would want to do but make it public that he is the father of your child and has been inconsistent in his duty.
You would be surprised what societal pressures can make a person finally act right. Especially Asians.-

May 3, 2025 at 5:35 pmI am sorry Op that you have to endure this. I am imagine how disappointed it must be.https://www.cede.co.in/empanelled-network/legal-organisations-and-ngos
Try them. Hopefully someone helps you pro bono.
Otherwise, hire a lawyer who can do the proveedings on your behalf via them.
Lastly, do NOT try to visit India. If he doesn’t care for his own daughter which in my opinion is a the lowest grade of human who is to say he may not try to harm you in any way.-

May 3, 2025 at 5:23 pmIs the baby even actually his? I don’t trust you. If the baby is his, prove it in court and then you can get child support. But, if you’re not married, I don’t think courts will allow it. Downvote me all you want. I don’t care.-

May 3, 2025 at 8:07 pmWho asked you to have a kid with him ? The legal system has deal with immature adults rather than dealing with actual injustice. Yuck.-

OP
May 4, 2025 at 1:28 amI didn’t ask for judgment I asked for legal advice to make sure my child is supported by both parents, as she deserves. Being a responsible parent isn’t immature. What’s immature is blaming a mother for a father’s neglect. If you can’t contribute constructively, move along. -

May 5, 2025 at 12:41 pmChild support is not based on marriage but on paternity. Get a court order for a paternity test and get him to own up.
