UHi everyone,
I am 20 years old and currently pursuing my undergraduate education. My parents have been living separately since I was 13, but they have not legally divorced. Since their separation, my father has not provided any financial support for me or my older sister. My mother has been the sole breadwinner, working abroad, which has made filing for divorce complicated due to frequent travel and that’s why we haven’t done anything about it for years. But seeing my mom give up here whole life to make ends meet for us make me angry at my dad for not even caring about us.
I haven’t had any contact with my father since I was 13, and he has completely neglected his financial responsibilities. Once I complete my undergraduate studies and secure a stable job, I would like to take legal action against him for failing to support us.
1. Can I still claim unpaid child support for the years he has not contributed?
2. What legal steps would I need to take?
3. Would my mother need to file for divorce first, or can I take independent action against him?Any advice or insights on the legal process in India would be greatly appreciated.

Cyour mother should immediately file a case under Hindu marriage act or Muslim law or Criminal Procedure Code Section 125… hire a family lawyer and he will take care of everything….Court has to order non custodial parent to send child support else there is no such rule that he has to send anything…For example your father might even argue that there is no seperation at all until last 6 months without any case filed..what would you show as proof? and also i don’t think filing a divorce is a good idea.. if he doesn’t have anything on his name and transferred everything to someone else then you guys will get nothing.. not even a single rupee
