February 14, 2025 at 7:13 amI am a new client to an already well-established manufacturer. I am going to provide them with my custom designs, but I am skeptical about it, as there are other old suppliers (with higher purchase power) selling the same product in my targeted region, and our common manufacturer might willingly provide them the product with my designs in order to increase their supply.What preventive measures can I take legally to keep this from happening?
[Things to keep in mind: My custom designs are not far-fetched from the regular ones, but they are new and still revolve around the traditional niche of our product. My investment towards manufacturing it is 2.2 lakhs (mentioning if it matters). ]

February 14, 2025 at 7:51 am1. Do you have an agreement with your manufacturer? If no, get it done.
If yes, do you have an NDA signed with him.2. Do you have any copyright registrations?
3. Have the agreement, very clear on who it can be shared it, and make sure you have the right to restrict sharing

February 14, 2025 at 8:14 amFirstly, Thank you for replying and I have some questions regarding the same:1. Currently there is no agreement signed, just word of mouth as, we have not processed the deal further.
2. Will I need copyright registration for every separate design that I produce ( eg. for each six same products with different designs ) ?
3. The “right to restrict sharing” also falls under NDA, no ?-

February 14, 2025 at 8:33 amGet design registered, under 2000 act.Design registration, will be, if your primary concern is to stop competitors or manufacturers stealing from copying the appearance of your products,if you are in creative markets, where you know aesthetics kinda thing.
Itβs always one design with one registration brother!!
NDA will cover most of your product. If you are short of budget and donβt have time. Just go with agreement now. When you get more projects out, start with registrations.
Get a physical agreement, be safe.
