February 2, 2025 at 8:06 amHello. In the 70s, my grandfather got a house constructed using his money ( that he earned from the United Nations) in our hometown. He got the house registered in my grandmother’s name. My grandmother passed away in 2010 and left no will. My grandfather then wrote a will in 2014 in which he has mentioned that the house was built using his own funds and that my grandmother had no ‘streedhan’ ( own funds/dowry etc ) so the house belonged to him. He has willed the house to my father.I have two aunts who reside in the US and UK respectively. Following my grandfather’s death in 2020, they have staked a claim to the house stating that as the house was in my grandmother’s name, it passes on to all four of her children after her passing. And that my grandfather had no right to will it to my father.
I have recently read some rulings where it is clearly mentioned that if the house has been constructed using the husband’s funds, then even if he has registered it in his wife’s name, it would still belong to him. However, legally we keep getting different opinions on the matter. So we aren’t really sure which way the court case will go.
My grandfather’s will is a proper registered one. I am clarifying that because that’s the first question we get asked when we talk to anyone about this matter.
