        There is a mutual settlement talks happening between both of our family as she is not willing to continue her life with me. We have a kid studying LKG. She didn’t show my kid to me from 6th month after which she applied divorce without any issues.
        Her lawyer created case just with generalised words which is not suitable for me nor my family as we didn’t have any dowry and are soft spoken as well.

        Suppose if the settlement goes well and if we get separated mutually,

        1. Can she file another case in future ruining my life once I move on?
        2. Will it affect my second life once I go for it?
        3. Will it affect my foreign job dreams?
        4. Can she apply on behalf of my child for school fees, college fees, Marriage spends etc?

          Once everything is settled through court and verified by lawyer and she gives in writing she is satisfied with present amount and won’t claim anything for her and child in future whatsoever, there wouldn’t be any claim from her side.
          Your child may claim right in ur ancestral property.

                If she doesn’t remarry, and if she can’t support herself financially then she can still file maintenance case on you. For maintenance, it doesn’t matter what you write in the settlement mou.

                  Please keep in mind the settlement for DV case and settlement for divorce can go simultaneously and are two different matters . Close friend was married in 2010 and was separated within a year. He got divorced in 2014 but the settlement for the fake DV cases went on, and it was resolved only in September 2024. Make sure the settlement is airtight, and there is no room for creating new cases, and all the FIRs are taken back.

                    well once you decide to get mutually divorced , you can add that condition that there is not case for dowry etc, ask your lawyer yo frame that clause in the mutual agreement.

                    yes, she can ask maintenance for the child, so its better you deal with all that while you’re going for mutual divorce, your lawyer will guide you through it.

                      2. Hire your own lawyer (advocate) to make sure, your interests are upheld.

                      3. She can file a case with respect to the child support or visitation rights in future, as the needs and demands of the future change. Hence try to make it very detailed agreement on this.

                      4. If you do not pay the maintenance/ child support she can file a case to get it executed.
