January 16, 2025 at 4:51 pmRecently on 6 Jan 1 AM my father and a co passenger got into an accident on haridwar highway. The other driver was on a scooty with no helmet, a male wearing a saree (but is said to be male by his family members) and was coming in the wrong lane and collided with my father resulting in his death and the car totalled, but my father is unscathed and co-passenger unscathed.
My father’s license is expired and so is car insurance expired couple months ago. The postmortem of the deceased reveals he was drunk. My father is afraid to fight the case and the other party is demanding 5.5L as settlement outside of court. Is it fair or should we fight the case?

January 16, 2025 at 5:58 pmThe criminal case will likely proceed, regardless of the settlement, as long as the FIR has been filed and the parties are named.Even if the family or involved parties do not want to file an FIR, the police have the power to file one on their own based on the information they gather or any evidence that suggests a criminal offense. Since it involves death by vehicle accident.
Lawyer up buddy. During police investigation, give statements proving the person suddenly drove to wrong side.
