March 9, 2025 at 6:10 amHello everyone,I had a fake case filed against me, which I successfully got quashed by the High Court. However, the case details are still publicly accessible. If I search my name on Google, the complete judgment appears on the **Indian Kanoon** and Casemine websites with the heading **”My Full Name vs The State of ________.”**
A simple Google search of my full name brings up all the details of the case, which has been really stressful and damaging to my reputation. Even though I proved my innocence, having this judgment out in the open still feels like it’s tarnishing my name. Friends, acquaintances, and even random people have come across it, and I’m worried about how it might affect my personal life and career in the long run.
I reached out to **Casemine** and **Indian Kanoon** requesting removal. Casemine removed the case, but Indian Kanoon rejected my request, stating:
*”Sorry, it is a criminal case and nothing can be done as per our website policy. As we notice, the information of the victim is already redacted by the court.”*
[https://indiankanoon.org/court_case_online.html](https://indiankanoon.org/court_case_online.html)Should I approach the High Court and file a petition to get the case removed? Or is there any other way to get this taken down?
Thank you for your help.

March 9, 2025 at 6:29 amRather than fighting with Indian Kanoon, your best solution would be to contact search engines directly.European GDPR laws have provisions that deal specifically with cases like yours – it’s called “right to be forgotten”. I assume India has some equivalent procedure.

March 9, 2025 at 7:47 amI just looked into it, and while India’s equivalent “Digital Personal Data Protection Bill” is currently in legislative pipeline, there have been already several court cases where similar situation were resolved under Constitution’s article 21 – right to privacy.https://chambers.com/legal-trends/the-right-to-be-forgotten-in-indian-law
SK v Union of India 2023 SCC OnLine Del 3544
Jorawar Singh Mundy v Union of India 2021 SCC OnLine Del 2306
From what I have seen, most operators just tend to apply “blanket” approach and grant such removal requests, even if it technically doesn’t apply in such jurisdiction – same as how all new iPhones have type-C usb port, even if relevant law requires it only within European Economic Zone.

March 9, 2025 at 12:25 pmThe case is in public domain, so legally Indian Kanoon is not in the wrong here. As far as remedies go I guess writ petition would be your best bet as some else has mentioned. -

March 9, 2025 at 1:35 pmOnce a court passes a order it becomes part of public domain. So the judgment of your case along with your name is already in public domain and there is no legal remedy available to you. -

March 9, 2025 at 2:13 pmThis Indian Kanoon guy makes a lot of money via Adsense and takes advantage of this loophole that the info is public and hence he is not liable.
The caveat is that
1) The public info on court websites is not indexable by search engines
2) he earns money through your private info.Go to HC or authorities with this argument. Best of luck!

March 9, 2025 at 2:20 pmWe had a similar case filed by a Dubai based NRI in Mumbai high court basically exerting his right be forgotten as his name whenever googled by his prominent clients resulted in a case of domestic violence leading a good percentage of them to believe he was a wife beater. The high court quashed his request so I don’t think you will have much success but I might be wrong.-

Don’t people know that ACCUSATIONS are enough to permanently destroy your reputation.-

March 9, 2025 at 2:45 pmIndian kanoon won’t remove it without court order. It’s mentioned in their FAQs. Only way is to file a writ and get high court order. But keep in mind, this might make your case even more visible.-

March 10, 2025 at 12:10 pmWrite to search engines and get it removed as a search result. There may be more such directories that can list, but the most prominent way it will get noticed is through search engine results.

March 10, 2025 at 9:24 amThe first thing that pops up on Google when someone googles my name is the case details. Friends and relatives who didn’t know about the case are getting to know now. I want my name and other personal details to be censored-

March 10, 2025 at 9:49 amWrite an application in court, checkout “right to be forgotten”. Then send the court order to Indian kanoon via email. Also email them first if they agree without court order. Maybe send a legal notice if they don’t respond to email.

March 10, 2025 at 12:09 amAll the suggestions here are good. Contacting google and asking them to remove the result is the best bet. You can also hire a PR agency who can get the result buried by creating many positive stories about you on the web. -

March 12, 2025 at 8:33 amI understand your case is publicly visible. But doesn’t the same have the judgement that you are acquitted? Just curious to know.-
UUser_02874aa4
OP
March 12, 2025 at 4:33 pmYes, it does. Even though I have been acquitted, I don’t want people to know that a case was filed against me with serious allegations. It changes people’s perception of me. I don’t want to have to explain to my friends and relatives about the case or what I went through. I just want a clean slate so that it doesn’t affect my career or marriage in the future. It would be ideal if the names of the accused were censored and the case was referred to only by its case number.
