May 8, 2026 at 8:00 pmHello all, I’m just trying to understand a legal situation for my parents.They’ve been involved in a check bounce case for about 10 years in a magistrate court and the judgement was given recently and it did not go in their favor and the judge ordered them to pay the fine (~1 crore) which if they don’t pay in 30 days, they will go to jail. They don’t have this money. My parents are told by their lawyer that they can appeal the judgement and have to do it in 30 days. What does that mean? What does an appeal process look like. I have poor understanding of these legal matters. If they appeal, does that mean they will go to court again for more hearing?
I’m very lost and shocked about the judgement and would appreciate any clarity. It seemed like arguments were good in their favor so I was hoping my parents don’t need to keep going to court again. But now I’m lost about the next step.
Update: For more context if other people comment/send direct message. This case is with a bank. Bank took blank checks and deposited them when EMIs were missed. People have messaged advising settlement. My understanding is that my parents have discussed settlement and the bank has verbally agreed in the past but would never give anything in writing as to the exact amount.

In a cheque bounce case under Section 138 NI Act, your parents have a statutory right to file an appeal against the conviction before the Sessions Court within 30 days from the judgment/order. Along with the appeal, their lawyer can also seek suspension/stay of the sentence so that immediate jail consequences do not operate during pendency of the appeal. In many cases, appellate courts may direct deposit of a portion of the compensation/fine amount as a condition for stay.The appeal process does involve further court proceedings, though it is usually based mainly on the trial court record, evidence already led, and legal arguments rather than a completely fresh trial.

May 9, 2026 at 4:03 amSorry, one more question sir/ma’am. What happens to the money the appeal court asks for? Does that go to the complainant? I’m trying to think of outcomes for both scenarios – assuming appellate court find outcomes in my parents favor vs not in my parents favor – what is the outcome then for each case.
