Yesterday night while I was driving in my bike a pedestrian (50 year woman )who is trying to cross the road came suddenly onto my bike and a collision occurred, I tried to avoid the collision inspite of my best efforts collision occurred leading to fracture of her distal tibia and fibula. I took her to nearest government hospital ( in which Iโm a doctor) and promised her good care and after listening to her problems even gave her some money for her daily expenses, she accepted her fault yesterday, now after some her relatives gathered she totally changed the scene and blaming me and asking for compensation for 6 months which Iโm not ready to give.
I told Iโll give her 2 months salary that too humanity basis and not accepting my mistake.
What to do now , please guide. -

March 3, 2025 at 8:22 amwas an FIR filed? or were the police involved? get a copy of that. Most likely, the police would have recorded that she was jay walking.Usually the only way she can get compensation is filling for compensation under the motor vehicles act. Your insurance company will be involved and if they see you havent violated any of their policy terms (your negligence did not cause the accident), then the insurance company will pay for the compensation. Other wise they will pay and recover the amount from you. It a long drawn legal battle but that is usually the way it goes.
My advise would be to ask a lawyer who does compensation cases under the motor vehicles act. And if there is any way to settle outside court.
If you give money from your own pocket without legal representation, who knows what amount they will ask from you next.

March 4, 2025 at 4:46 pmExact thing happened to my dad . Initially they were okay with the compensation my father offered, full medical bills paid, then they decided to take advantage. Insurance got involved and they used their own lawyers to fight the case in court and insurance won. -
