April 25, 2026 at 5:02 pmMy sister works at a company in Delhi and has been employed there for 4+ years.Their HR told her that:
* She will get only half salary during maternity leave
* This will be paid only if she continues with the company for 1 year after returning
* These conditions were also included in a bond she was made to sign
* Nothing else has been formally shared as a proper policyThis sounds very wrong to me. From what I understand, maternity leave should be fully paid and not tied to any retention condition. And the HR tricked my sister into signing the bond as she requested WFH for a month before the maternity leave.
Can a company legally enforce such a bond for maternity benefits? Has anyone dealt with something similar in Delhi?
Also, what would be the best next step? labour complaint, legal notice, or trying to resolve internally first? I don’t thing trying anything internally would work. Also, my sister is little scared as she signed the bond and little worried about the hassle of legal cases as she is already really busy with the new born (my bhanji)
Any advice would really help, also any social help group or someone here with contacts that can help resolve this would be much appreciated.

Edit: Found out those leeches made her sign that if she doesn’t join for 1 year she instead have to pay back 6 months of salary forget the maternity pay.
