I recently hired a local worker to build a concrete staircase in my house. The work included two sections (lower half and upper half). I paid him after he completed the work.
The problem is that the upper half of the staircase is built at a very steep angle and feels unsafe to use. It doesn’t seem to follow proper staircase proportions.
When I complained, the worker agreed to come and fix it, but he has been delaying every day. It has now been around 2 months and he still hasn’t come, despite repeated calls.
I have:
* Proof of payment (UPI/cash record)
* Call/chat history where he promised to fix it
* Photos/videos showing the staircase condition
My questions:
1. Can I legally demand a refund or compensation for defective work?
2. What is the best way to proceed in India — consumer court, legal notice, or something else?
3. If I hire another worker to fix it, can I recover that cost from him later?
Any advice would be really helpful. Thanks!
