        Hi all,

        A close relative recently lost her husband. Unfortunately, due to lack of nominee details, it seems succession certificate will be required to get the assets transferred to her.

        The value at stake is 50 lacs+.

        We are talking to different lawyers but finding difficult to understand how to make final choice on how to proceed.

        Wanted to understand from the community –

        1) What would be the typical cost in such case?
        Across court fees, lawyer fees and other things (e.g. newspaper notice)

        A lawyer we consulted quoted almost 8% of value (3.5%+4.5%), but seemed confident to get it done.

        2) How much time this typically takes? We heard 6 months

        3) What are some risks to be managed?
        To ensure it goes through and we get the certificate.

        4) How should we structure the payments to link it to the success? To avoid burning money with nothing in hand

          4 lakhs + just sounds ridiculous. It is a fairly standard document. You don’t need a hotshot lawyer to obtain one. Go to the District Court premises and you will find several lawyers or even touts there who should be willing to do it for a few thousands.

            1) **Cost Breakdown:**
            – First off, this lawyer quoted you 8% of the value? That’s **ridiculous**. Anything over 5% is highway robbery. Typically, in Chhattisgarh, lawyers charge anywhere from 2-5% for a succession certificate depending on the value of the estate.
            – **Court fees**: Expect around Rs. 500 to Rs. 5,000 depending on the value of the assets. It’s not much, but it can vary.
            – **Notice in newspaper**: The court will ask for a public notice in a local newspaper, which costs around Rs. 1,000 to Rs. 5,000.
            – **Total estimate**: Ideally, for a 50 lakh estate, you’re looking at around Rs. 1 lakh max if you’re paying fair fees (including the lawyer, court fees, and newspaper notice). If the lawyer is asking for 8%, then that’s pure daylight robbery. Get a second opinion.

                One question – just want to double check on court fees. Some forums say it can go up to 3% of value though with an upper limit on amount. Any publicly available data to validate the official number ourselves?
