JI’m sharing a distressing experience with Mahindra’s two-wheeler subsidiary, Classic Legends Pvt. Ltd. (makers of Jawa/Yezdi). They’ve filed a defamation case against me in a Pune court simply for posting genuine reviews about my ownership experience.
Context:
* I highlighted repeated mechanical failures (with videos/posts) where numerous parts were replaced under warranty, pointing to a faulty product.
* Their defense? They claim their records don’t reflect these repairs. But here’s the catch: they don’t provide bills/receipts for warranty work, making it easy to manipulate records. However, I have proofs of some parts being replaced why they have deniedTheir Demands:
1. Pay Rs5,00,000 + 18% interest.
2. Take down all critical posts/videos.
3. Cover their litigation costs.My Reality:
As a 25Y old who has parents to support at home, I’ve already spent Rs 50,000+ on legal fees for fighting the consumer case filed against them in the district court. Fighting a corporate giant feels impossible when they have endless resources, and I’m just trying to expose the truth and help others in making an informed choice.Can someone help fight the case on Pro-Bono basis (Free of Cost) and keep the litigation fees when we win the case?

Also you can contact consumer organizations in your area, send mails to news organisations and youtubers stating Mahindra’s case against you. Get your family members and friends also to post it in social media about this case
Its upto Mahindra to prove that you are guilty not you. All you need is a get a lawyer who knows the basics and can prevent you from saying something stupid.

DI feel sad for you, honestly, I would have helped you if I was in your city. I will give you some advice, you have two options
1) Reach out to the lawyer and request a sit-down with someone from company stating you are willing to settle – Tell them you can’t afford all this, and if they take away the case, you will remove post and maybe an apology to them, if they give in writing that they will desist from all action now or in the future. I know this will hurt you but not all battle are meant to be won, and you can get out of this fix faster and save some money and rationale.
2) Fight Fire with Fire –
a) File a complaint with National Consumer Helpline, use chatgpt and file an online consumer complaint as well. Also, write to Central Consumer Protection Authority telling about Mahindra’s predatory behaviour.
b) Did you every pay them for this issue? Was it paid digitally? If so and they haven’t shared invoice, ask for it, if they refuse, file complaint with GST authority.
c) Use your google location history, gps data, cctv footage, whatever other evidence you can think of and take the most influential person you can find along with a lawyer to get an FIR filed against them u/s Section 316, Section 437, Section 356, Section 237 of BNS. It will be hard to get it registered, if it fails, go u/s 200 of CrpC, this will create pressure on Mahindra legal team.

VWhile there may be someone who might agree to your proposal (if they are free and don’t have much work)
But do know
An advocate practising in India is expressly barred by law from charging a fee contingent on the outcome of a legal proceedings as per The Advocates Act, 1961.
All you need to know is if the statements made by you are not false or untrue you need not worry much about the outcome.
The company will end up spending more than they can earn.
If you don’t have the bandwidth to fight them agree to delete the videos and settle the matter.

FWalk into a legal aid cell in the court house of the court where the case is filed. Please see if they take your case. Legal aid is for individuals who cannot pay for lawyers.

UNews channels nowadays typically don’t take up such cases as they don’t want to lose out on ad revenue but you can still try a few that have historically reported on such matters. But definitely try to get a post about your ordeal on Teambhp somehow if you can. That gets a lot of attention among enthusiasts and industry circles and it’s one platform manufacturers hate. They don’t have much control on UGC (user generated content). Also post Google review of the dealership where you got your bike serviced. Wish you success!

I don’t think their case will stand in the court.
They are just threatening you to remove the negative review.
There is a judgement from Madras Highcourt about such cases.
Reviews cannot lead to defamation.

UDefamation cases usually favour the defendant that is you the OP in this case. It is very hard for them to prove that you have defamed them especially when what you have written is true and can be proven so. Do not budge OP, hire a good lawyer and fight the case. Do not pay their settlement, they are trying to extort money from you

UI recently serviced my car in Mahindra. When I went to collect my KUV 100 half of fuel tank was empty. Even GM agreed that it was because their employees might have used it and they can’t keep control over everything. They gave me compensation of 1k. Post that next day I see CNG is empty and not working. I go back and rant on them reason being they had not fixed the parts of cng and damaged something while repairing the tailgate. I kept the car exactly at their service centre gate and told them if you don’t repair it I won’t move my car. Later they repaired it and sent back in evening apologizing for their mistakes. You always complain to mahindra service about the service centre. They definitely solve the issue. Previously also it has happened where they have not installed parts but have put bill for that. You don’t go and put blogs or videos on it.
