The son (27M) is a freeloader, psychologically problematic, might have drug issues and abuser. He was in psychiatric ward for 6 months a year ago, again changed. He has a brother working in the States. He blackmails him for money saying he will harm his parents. Even forcefully taking money from parents, else he does property damage at home. The family isn’t comfortable financially, they struggle. He also have multiple cases registered by various girls saying he uploads their selfies after break up or is stalking them. He pawned one of their bike, the other Scooty is with police and fled with a friend’s scooty. Today he attacked his father (not violent) for a mobile phone but there’s a video recording of him. Is there any strict laws that can actually get rid of him? A lawyer said this can go to court but till he is found guilty, he will be roaming freely and possibly might harm parents. The family is done with him and his torture. Please suggest if this family can get any help?

Wow want to get rid of a son! Seems the parents didn’t raise him properly. So what will happen once you disown him..he will most probably commit suicide or be murdered. If you can’t handle, don’t give birth.

NAL . Go to police . They are usually very sympathetic towards old age parents . One or two days getting police treatment will straighten him

The parents aren’t too old. The police came and went back, almost like they didn’t want to work

Officially parents can’t do much but unofficially they can do a lot of things.

At 27, he’s an adult. Even if the entire family cuts him off, there is not much action he can take legally. Also ask your parents to write a will at the present excluding this person, making it clear that he would not be inheriting any property. Also, update the will when needed. Kick him out, that’s all and go no contact. After that if he tries to harm the parents by entering into the house forcefully or abusing the parents physically or emotionally then action can be taken by the police since now there is strong proof of abuse. Also record all the threats made by him so that you can use it in your favor.

Thanks for the comment. They earlier tried to make a restraining order but the lawyer said it’s not worth it. I don’t think they have any properties to write a will. But this guy demanded 10 Crs saying he will go away, in reality the family is very much dependent on pay check to pay check of their elder son. They all kicked him out earlier but he still came in. The worst is his mom is semi paralyzed and he uses her as a pawn to get things done, like shouting on her, forcing her to give money or threatening he will harm the dad.

Go for a restraining order on the grounds that he is abusing your elderly disabled parent. I don’t know why the lawyer said it isn’t worth it, you can ask for a second opinion from another lawyer if needed. In that way, you can at least take some action on him if he violates it.

Also the parents can write directly to Magistrate if the police refuse to file the case. I hope the family heals from this, and gets the help they need. Try contacting any NGO near their place if needed for additional help.

One strategic advice would be to shift to village for few yr because genz teens usually like city and urban life . He will abscond them once his life style change significantly. Or move to some ashram.

Bhai, OP said that they’re living pay check to pay check, how will they work while staying in village. The parents need to seek a lawyer for a better advice. And 27 yo is not at all a genZ.

File case under senior citizen act for eviction of that son. Also register FIR for threats verbal abuse and criminal intimidation

Maintenance and Welfare of Parents and Senior Citizens Act, 2007. They can seek protection from RDO/ Collector under this act, the son be restrained from entering into their home if he is abusive and violent. They can write a will with regard to their properties if they are Hindus/Christians and about 1/3rd of their property if they are Muslims… if they want they can transfer their property to their other son even when alive…

Then file suit for declaration regarding disowning and permanent injunction restraining him from harassing parents.
Sin can be disown from self acquired property of parents and not from ancestral property.
