        A friend of mine recently shared some personal issues with me, seeking advice and help.

        About three years ago, he married his girlfriend after a difficult struggle to convince her parents. Eventually, he succeeded, and they got married. After their marriage, my friend supported his father-in-law financially, contributing around 12 lakh INR to help him in his battle against cancer.

        However, a year into their marriage, he discovered that his wife was cheating on him with a man from their society. She convinced him that it was a mistake and promised it wouldn’t happen again. But she was unfaithful again—this time with another man. Once again, she managed to talk her way out of it. However, the final betrayal was even worse. She was caught having sex in my friend’s house, in his bedroom, with yet another man from their society. The most shocking part was that it was my friend’s father who caught them. This must have been incredibly awkward and painful for him.

        This time, she could not escape the consequences. Discussions followed between their families and a lawyer. When they got married, she had brought 20 grams of gold with her, but she falsely claimed to the lawyer that she had brought 150 grams. When asked for proof, she presented pictures of gold ornaments that had actually been gifted to her by my friend’s parents. However, my friend provided bills and receipts proving that these ornaments were purchased by his family. Despite this, she continued to insist that they were gifts from her own family.

        Eventually, they reached a settlement of 5.5 lakh INR, though only 2.5 lakh was officially documented in the agreement. They have decided to live separately for a year, after which they will file for divorce.

        Now, my friend is worried about what might happen in court. Will there be any legal complications for him? How much more might he be required to pay her?

          Who is paying 5.5 lakh? If your friend is paying then document it and send all the money via online mode only. No cash transfer.

          Better to consult a highcourt lawyer. Just google high court divorce lawyer near me. Reach out to 3-4 lawyers and get their opinion on your friends case. If they are pricey then don’t consult them.

            You should get proper documentation that she won’t file any cases on you. Many a times the wife takes some part of the money and then backs out of the mediation. And those mediation document should have the seal of approval of the mediation authority only then it will be legally binding and valid. Otherwise not.

            Also why is there 2.5lakh difference? Either you are not telling something or they are planning something fishy. Get a good lawyer.

              While applying for the 13 B application, make sure to add thr 5 lac as settlement and Mutual separation term.

              And add 5 lac DD. Also mention DD number with date. Submit to thr court at the time of filing and take it out when court gives the final decree.

                  Lawyer here.

                  There is a lot to unpack, discuss and future course of action decided:

                  1. Whether a Divorce needs to be filed at this stage (whether Mutual or based on Adultery)?

                  2. Whether a Criminal Case needs to be filed against the man from the society (based on criminal trespass, etc.)?

                  3. Whether they should, at all, live separately or not? What purpose will that serve? How sure can one be that they will file for Divorce after 1 Year?

                  4. Whether Judicial Separation is also an available option? Should a Separation Agreement too be executed?

                  I would suggest seeking assistance of a trustworthy and experienced lawyer for this.
