Iโm looking for legal advice regarding my previous employer in Bangalore.
I worked at a small startup where, at the time of joining, they collected my original documents (educational certificates). I have now resigned, completed my notice period, and my last working day is over.
At the time of exit, HR informed me that my original documents would be returned within 7 days. However, it has now been more than 20 days, and despite multiple follow-ups, I have not received them. There has been no clear response or timeline from their side.
This is causing me issues as I may need these documents for future employment.
I would like to understand:
Is it legal for an employer in India to retain original documents after resignation?
What actions can I take now (legal notice, police complaint, labour commissioner, etc.)?
What is the fastest and most effective way to get my documents back?
