February 13, 2025 at 11:24 amHi all, I work at a tech firm based out of Bangalore and I’m currently serving my 90 day notice period. We have recently received our appraisal and variable bonus payout letter for the year 2023-24. We should have received it last year, since this is for the assessment period between April 2023 and March 2024. However, due to various delays, we have only just received it. It says the payout of variable pay and arrears should be done in the nevt 10 days. The appraisal is applicable from April 2024. In the same letter, the employer has also mentioned that variable bonus payout will only be done if the employee is not on notice period on the date of disbursement. No clause referencing arrears payout is mentioned. The expected date of disbursement is 24th Feb, 2025 and my last working day is in first week of April.As per the employment agreement, employees are entitled to variobale bonus payout if they’re employed by the company on the date of variable pay disclosure. No clause regarding eligibility criteria for arrears is mentioned.
In this scenario, can the company deny paying arrears and variable bonus to me? And if yes, is there anything I can do to get the money from my employer?
