Factory not returning advance for goods

I have recently started a business, and i paid a factory advance money for goods, it was supposed to be delivered before diwali, they sent 40% of the goods which was subpar and are not sending the rest of the goods.. I keep calling him and he wont pick up and whenever he does he will make an excuse that we will send the goods tomorrow or so… I know obviously he has no intention of sending the goods or returning my money, can anyone please help me with this.. Is there any action i can take against him.. I paid him through bank ac and he has sent a bill for the goods but hasn’t actually delivered anything no shipping copy or any document
