FnF not settled by company

I joined a startup(LLP) in 2023 and after working there for about a year I was laid off along with several other employees. Now our FnF was never given in written- when will it be settled, what’s the final amount etc.

It has been a year now and even after multiple follow-ups, calls, in person meeting they have the same excuse everytime that they don’t have the sufficient funds.

I along with 2 other ex-employees reached the local labour court and filed a complaint. Every 15-20 days we went there and the officer told that they have sent a summon. After 3 such instances the company’s lawyer contacted us and told us that they will pay by Feb 25. Now today we met and they told us that they still need time.

What to do in this situation. The company is based out of Gurgaon, I have moved to Bangalore. Is there some way to pursue this from Blr or not?

The amount is significant so can’t forget about it.

Lawyer here.

Usually sending a legal notice is sufficient as after 90 days, they have to pay interest over such delay. Thereafter, a case is the way forward.
