April 1, 2025 at 6:25 pmA cultural society from my college rented Smart Bikes on 31st March and rode from Lodhi Garden to India Gate. At the end, most students returned their bikes, but three of my friends were too tired to ride back. They parked them near India Gate and took the metro home.Later, the rental company called, saying one bike was missing. They found the other two, but the third was stolen because my friend forgot to lock it. When the owner called, my friend panicked, said he did not know where it was, and cut the call. The owner then obviously filed a police complaint.
Today, on 1st April, my friend was called to the police station. The bike owner demanded seventy thousand rupees or the stolen bike. My friend insisted he had locked it, but the police started shouting at him and refused to talk to his father. By the time my other friends reached, the senior officers had left, and the juniors said he could not be released until the seniors returned. Now he has to stay at the station overnight.
I only just found out about all of this while writing this post. I know my friend was reckless, and this is a consequence of his actions. He had parked bikes like this before without an issue, which is why he did not think twice about it. But this is the first time something like this has happened.
Are we missing something? Did the police handle this correctly, or is there anything we can do in this situation? Any advice would be appreciated.
TLDR: My friend rented Smart Bikes, forgot to lock one, and it got stolen. The owner filed a police complaint, and my friend was called to the station. He is now being held overnight. Looking for advice on what can be done.

You caused damage to someone and still you are trying to find some legal loophole to ensure you don’t have pay damages .-

The questions will be raised regarding the nature of the crime, the intention behind it, motive, actions leading to loss. The person whose culpability has been defined without any ground of guilt is a college student here, this will fall flat. I don’t think any FIR has been filed here, it’s just an informal hold up.-

April 2, 2025 at 3:09 amActually smart have gps system in built so they can be easily tracked and even they can be locked remotely if it has sim card installed. When you rented bike you should have been logged out or update your bike location right -

April 2, 2025 at 3:43 amIf he is being detained then they have to file a case. If they are not filing a case then they probably took some interest in the matter based on the owners complaint. Either way detaining him is wrong.Get a lawyer, give a written complaint and take acknowledgement or get more people involved.
