Get refund of penalty in delayed registry

Buyer has paid the penalty for delayed registry for his flat in Greater Noida. How to get refund as this was not Buyer fault for the delay. This was because of some issue with builder and GNIDA. Do we have any redressal forum in India/U.P ? Or buyer would be looted by govt/ builder like this ?
