My friend lives in Canada. He came to Pune to meet a friend and later went on a trip to Northeast India with him. During the trip, his friend rented a car, crashed it, and asked for money to pay the penalty. My friend transferred 56,000 INR to his account. Itβs been over a year, and the guy still hasnβt paid him back. What should he do? If the legal process requires sending a notice but he doesnβt have the guyβs address, what are the options? Also, can he fight the case without appearing in court?Reposting for more π

January 18, 2025 at 7:23 amLegal notice can be sent in the mail too. However it’ll not be the best option as he would simply ignore it and later claim he never received or saw it. Legally it would be very hard and a long process to get your money back. Under civil law you can go for money recovery suit. (Most probably in small causes court ). The process would take time a lot of legal fees.A better option would be under criminal law, if you can manage to file a complaint for cheating (proving that the friend never had any intention to return the money in the first place is important here), that would pressurise the friend more into giving the money back.
Irrelevant but a non-legal advice would be to name and shame him.
