January 11, 2025 at 3:34 pmHello,My father purchased a 3000-square-yard plot in our hometown in 2008. However, the property had a tenant who has been occupying 300 square yards since 2004. The tenant used to pay βΉ3000 per month as rent, but for the past 10 years, my father has been asking him to vacate.
Since the property is on prime land of the town, the tenant avoided the conversation, but in the last two years, he has started demanding βΉ30 lakhs (15% of the current market value of the land he occupies, which is worth over βΉ2 crores) in exchange for vacating.
My father stopped accepting rent from him three years ago. Meanwhile, the tenant owns an additional 800 square yards adjacent to our property. My father’s office is located on the same 3000-square-yard plot.
We are seeking advice on the best course of action to evict this tenant. What are our legal options under Indian law? Any suggestions or experiences would be highly appreciated.
P.S.: The property originally had three tenants:
1. The tenant described above.
2. Another tenant occupying 150 square yards, with whom we settled for βΉ3.5 lakhs as he was running a business on the property.
3. A tenant who was an irritant, occupying a godown similar to the current tenant. One night when he was away, my father broke the locks and threw his belongings out. He never returned, but my father still paid him βΉ1 lakh afterward.
However, we cannot take similar steps with the current tenant as he is backed by a local, powerful “white-shirted” guy. -

January 11, 2025 at 7:09 pmSimple solution what my known did was he paid someone 10-15k to cut the main wire and take the electricity meter. And report that the meter got stolen. Now refused to apply for a new meter as he was the property owner. The tenant had to eventually vacate because there was no electricity.-

January 11, 2025 at 8:55 pmIt’s actually illegal to do so. If somehow he gets caught doing this due to CCTV or whatever owner will be in troubleΒ-

January 12, 2025 at 6:25 amAnd what the tenant is doing is also not legal ! And he personally doesn’t have to do it. Koi bi chota mota charsi mil jayga jo ye kaam kar dega. Difficult situations require difficult solutions. ! It’s tried and tested-

January 12, 2025 at 6:28 amI added the warning for the OP. No point in arguing with me. You or anyone can do anything they like. This is a legal sub. The caveat of this being illegal is basic etiquette. You can get anyone to do it for you, the blame will be on the owner when the person is caught.
