UHi, My family owns a CL9 bar license in Bangalore which I would like to shift it into my friends restaurant premises but there are certain complications which I need help with-
1. My friend has leasehold of the premises (build to suit)in his personal name for another 15 years. In the original lease deed it is clearly mentioned that he would not sublease the premises. From the past five years the relationship between my friend and the landlord has deteriorated and so any changes to the agreement is risky.
2. Since it is one single parcel of land I am told that only one trade license can be issued which is already in my friend’s name. The trade license will be mandatory to shift my bar license the said premises.
I am thinking of setting up a partnership firm giving my friend 10% ownership in the bar license and making him the managing partner so that on paper it would be just him running both the business and.I would like to know if this will violate the original sale deed? Will it create problems getting trade license from the municipal authorities? Is there any other way forward?
