March 27, 2025 at 4:40 amMy dad passed away in 2021 leaving behind the flat we currently live in of which he was the sole owner. Now I want to transfer it in our name(my mom and 3 siblings).I did my online research and enquiry. Got to know that in absence of Will, the case goes thru court, which issues Legal Heir Certificate for the property which has the names of other family members.
However, on enquiring at the shops near the Sub-Registrar Office that make documents for flat sales, came to know that it can be done without the court and gave me an amount that was less than half of what the Court approach would cost.
Are these guys scamming me or it really doesn’t involve the court procedure.

Generally, names are recorded in revenue records and no long process of required, you only have to obtain the pedigree certificate from your local office by filing an affidavit stating all legal heirs.
Make enquiries at 2-3 places before zeroing on. -

March 28, 2025 at 12:02 pmNormally you get succession certificate from court that cost 3 or 4% of flat value and then submit that to the local corporation to get records changed.The agent might draft a bogus will and might get it done. Not sure
Remember any shortcuts will create problems when you try to sell your flat in the future. The buyer/bank might not be ok. So please keep this in mind
