        Hey everyone, I need some help regarding a tricky situation involving my grandparents (Nana & Nani). They’re in their late 60s now and have always lived in a small village in Gujarat, where they were born and raised. Even though their sons moved out of the village a long time ago, my grandparents have decided to stay and rebuild their old house instead of leaving the village.

        Now, here’s where the problem starts. The house they’re rebuilding was originally built by my great-grandfather over 80-90 years ago. Back then, it was designed with a red-brick roof on the second floor, and rainwater used to leak into the house through some open spaces. To deal with this, my great-grandfather and the neighboring elders agreed to install a rainwater drainage pipe that passed through our premises. The deal was that this pipe would only be used to drain rainwater from their roof—not for any other purpose.

        But over the years, as the elders who made the agreement passed away, the neighbors started using the pipe for everything—washing clothes, utensils, and other daily drainage needs. The water now drains right next to the main door of our house, making it almost impossible to live there comfortably.

        Now that Nana and Nani are rebuilding the house, they’ve decided to put an end to this. They’ve removed the old roof, so there’s no reason for the drainage pipe to even exist anymore. In our view, the neighbors no longer have any right to use it. But instead of understanding this, the neighbors are now trying to involve other village elders and even threatening to file a police case to force us into letting them continue using the pipe.

        This is where I’m stuck. I want to help my grandparents protect their land and their rights. It’s their property, and they have every right to decide what happens on it. I also want to be prepared in case the neighbors follow through on their threats. Here are a few questions I have:

        1. Do the neighbors have any legal right to keep using the drainage pipe now that the roof it was installed for no longer exists?
        2. What laws protect my grandparents’ right to their land and their decision to stop others from using it?
        3. If the neighbors file a false police complaint, how can I protect my grandparents from arrest, especially since they’re senior citizens?
        4. Are there any specific laws or IPC sections that I can use to make sure my grandparents aren’t harassed?

        I came across IPC 499 (defamation), but I’m not sure if it applies here or if there are other laws I should know about. I really need some guidance to make sure my grandparents are safe and their rights are protected. If anyone has advice or knows what steps we should take, please share!
