February 8, 2025 at 12:16 pmI will be keep this short but ill try to add every detail2017- i had accident, (it was truck drivers fault) my father passed away.
This lawyer who is related to us (dur ka )
Came to my brother for case, at that time he mentioned his fees would be(10-12.5%)
Now this case is going on in tier 3 city.Now we talked about his fees over many times (our fault was we never asked in writing and cleared it well)
Its been almost 7 years.
We have 3 cases
1. Death claim (fathers salary based)
2. Injuries claim (me and my mom)(who were in accident too)Now case no 1 is declared and we got around
60-70% of what we askedBut opposition have went to high court,
So we had to hire hc lawyer(our lawyer did it)
So while asking for his fees, our lawyer wasnβt making clear about percentage ( he was telling βhalf of mineβ)So i clearly asked about his fees now and its 15%
(So 15+7.5) cause death claim cases takes time and money too (he mentioned 4-5lacks)
Mentioned that for death claim fees is 15% and for injuries its 12.5% (we were gonna that 12% from start)
I mentioned case is already taken too much time too and now you are making changes in your feesAs every lawyer speaks he said donβt worry, we will do talking later, we can do negotiations.
What should i do now and how can i proceed better communication with him and set this 15% or lower fees ?
Any advice anything i can do?
I was 16 when this happened and we did not had anyone to advise us at that time so a lot of fuck up have happened till now. -

February 8, 2025 at 12:33 pmLawyer here based in Delhi. Ideally, fee is something which is decided early on unless the other party wants to take advantage of you, which might be the case here. Discuss with your lawyer, and atleast have some sort of correspondence over mail or WhatsApp to fix fee. Don’t keep it vague in % wise. Even if it’s %, make sure it’s clearly decided.-

February 8, 2025 at 12:40 pmIf he doesn’t respond, just write him over through text saying “we wouldn’t be able to pay you more than ______ % or _____ rs. Owing to our situation (put up all the adversities you’re going through in life)”.This should create a trail of talks.

February 8, 2025 at 12:55 pmA lawyer that doesn’t discuss their fees upfront is not a good lawyer. Make sure to discuss the fees through email.
