AI placed an order for jewellery with an Instagram online brand. Their page has about 30k followers. My amount is ₹3365. I placed my order on march 10 and due to product unavailability they said expect the delivery to happen within a week. It’s been more than 18 days at this point. And the person has ghosted me. No replies. Vague replies. Sent me a fake tracking link. I contacted the delivery company and they say that the seller is not giving the products and we can’t do anything. Contact the seller. I am tired of co ordinating with her. When my partner messaged her that we will complain legally, she blocked him. As of right now , I’m fully ghosted. The last message they sent was they will get back after “ Iftaar “. Imagine scamming people during the holy month? They also said that they will wefast the products. All lies. How can I get my money back? I’ve proof of payments and chats? I’ve been polite and patient and today I’m finally breaking down crying because I have not experienced this before and the person has quite literally tortured me for a mere reply and update. No update on my order whatsoever. And they refuse to reply about any refund. How can i proceed legally?
I don’t have her number or I don’t know the owner. They’re just based in Mumbai.

Lawyers please help with a viable legal route to complain and get my money back. PLEASEEEEE!

DIf you have paid using Credit Card.. you can raise a dispute. Most banks offer this – Payment done, good&services not received. Slow process, but good chances of getting money back.

HNAL but always use a credit card for something you think is a bit fishy as a precaution or always use one for online transactions

Hthen just write to them that you are marking this payment as a fraud if you are not going to deliver or give an update
and if they don’t provide you with any update then just flag the payment from your account-
AShould I email or get on call with customer care for flagging the payment?
We’re way past messaging or telling the brand anything. There is absolutely zero response from their end. And the one time my partner messaged them that we will complain , they blocked his profile. And I’m not going to be surprised if they block me eventually. -

WFirst of all, don’t use prepaid options for random websites and Instagram stores . Cash on delivery.
Second , do you think the time that you will spend on follow ups , venting on the internet , and doing random things is worth 3k ? Ever heard of the sunk cost fallacy .-
ANope. I feel it’s totally worth it. Because just like failures , in life , you don’t stop trying and fighting for your rights. Don’t try to act cool because it’s not your money.

ADidn’t ask for life lessons. Asked for legal advice. You cannot decide what’s a definite amount for me as “ sunk cost “. It’s as simple. I was robbed of my money. And the Instagram store isn’t random. It has 30k followers and actively recommended by many. I happen to be unlucky. But rather than giving me actual legal advice you want to sound like you’re some who is superior and I’m dumb because it’s a small amount. I may cry or laugh and go to sleep. I really don’t see why you’re so shallow and crass. You have not replied anything in context. Get off your high horse.

Anyway, you want to take the legal route against an Instagram handle for 3k. You are willing to spend 1000x more money and time on lawyers and processes .But didn’t realize that you were so wronged . Let’s get the Supreme Court judges on this please . This person got scammed by an Instagram handles because wanted to save money by avoiding cod ( prepaid offers are offered on discount for a reason ).
If only your greedy ass would have seen that, you wouldn’t be arguing with strangers online-

WSo why order from shady websites that don’t offer cod ? Why even scour through Instagram to search for such obscure stuff that usually people don’t care about . How is that putting your time to good use .
Are you so naive that someone flashes a trinket and then you need to have it. Is that your purpose in life ? Make mistakes , get scammed and then cry about it . If you have a website then I am happy to make a small donation so that you can buy a handkerchief to wipe your tears -
