UHi everyone,
I’m working in a private company in India and planning to resign due to a very toxic and stressful work environment.
Recently, one of my colleagues resigned and was terminated the very next day, which makes me concerned about how the company handles exits. Because of this, I want to resign and leave immediately (next day) when I decide to do so.
Some key points:
My role does not involve any unique or critical responsibility—everyone in the team does similar work.
I have already trained 2 team members as backup and have email proof of knowledge transfer.
So, from my understanding, the purpose of the notice period (handover) has already been fulfilled.
The company usually takes months to hire replacements, which I believe should not be my responsibility.
Additional concerns:
I have completed 2 years in the company.
I did not receive any appraisal or promotion.
A newer employee received an appraisal despite less experience and contribution.
I have handled extra responsibilities and trained new joiners during staff shortages.
My questions:
Can I legally resign and stop working immediately without serving the notice period?
If the company asks me to pay for notice period buyout, am I legally bound to pay it?
Can the company legally hold my full & final settlement or relieving letter if I leave immediately?
What are my legal options if they refuse to process my exit properly?
I’m based in India, so advice specific to Indian labor laws would be really helpful.
