January 14, 2025 at 8:21 amHi everyone, seeking your help on this issue I’m going through right now.
So my late grandfather had a will (not registered) that the properties needs to be shared between my father and uncle equally. Last year my father passed away and I moved out of the house to banglore for job. I don’t have siblings and mother left us when I was young. I know they were not divorced but she was living somewhere else and I don’t have contact for the past 10 years.
Since I never had a interest in this property matters, I refrained from conversations with my uncle since it felt like bad from my side and I trusted him.
Last month I came to know that he has written a will in a way with help of my grandmother that the property will be shared in 3 – 1part for me, uncle, and then whoever takes care of grandma. My grandmother was taken care by me and my father until last year and after that she shifted to my uncles place. She has minor signs of alzheimers and is living under pressure of my uncle and he takes away her pension as well.My questions I had was:
1. Can my uncle decide on the will? Grandpa’s will is with my uncle but he is lying that it’s not with him and is lost.
2. Is there a way I can raise a legal dispute or will the effort go in vain.Thank you
