Is NoC from society is necessary before selling the flat?

Is there a rule that NoC is necessary before selling the flat?

They are demanding 10k and I don’t think I m okay with it. Maintenance and dues are all paid and cleared. Now just because we are selling toh 10k ?

If they are not giving bill for noc then no need to pay, because society noc is not needed for resell of flat. New owner will deal with society in his own way.

Ask for invoice and bill for 10k

If you think it’s illegal challenge it in a civil court and ask for lawyer fees and everything

Bhai court ke chakkar me nahi lagna hai. That will take more than 10k from me and all my time and peace of mind which will be more than paying the 10k to the society.

Housing society can charge up to ₹25k for issuing NOC for selling flat aa per by laws of Maha rera.

NOC is only required, if the building is registered in society’s name and the portion(flat) is allotted to you + with condition requiring prior approval before sale/gift. If both of these conditions are inapplicable in your case, then NOC is not required. However, if those two conditions applies, then it can be bypassed by using power of attorney.

Yes there were allotment letters given at the time of possession. No one actually got a sales deed even from the builder. It was in 1998.
We have 8 buildings in our society now I don’t know if the building is registered in the society name. But we have a share certificate mentioning the flat no and building no…

You may ask for bill from society
While going for registration, you might need NOC to even before registry
