        I work in a 5day work week establishment and the gratuity eligibility is 4years 190days, of which, I’ve already completed about 4 years 5months+.

        If I resign now, the notice period(=2months) would make my tenure more than 4years 190days required for gratuity entitlement.

        My concern is if the organisation buys out the notice period by paying me the salary for the 2months and relieves me immediately, will I be denied of my gratuity entitlement?

        In case of notice period paid in lieu, is the notice period that is bought out (2months) also considered as part of continuous service for the purpose of gratuity entitlement?

        If there’s any additional information required, please ask.
