        Hi All

        Wanted to know if we can take any Legal Action against Start Up rolling back offer citing vague reasons and without any ground.

        I was doing excellent in my previous organisation and I quit only for the better opportunity and pay offered. Now I am stranded with no job and no pay. At least, the company should compensate for lost pay and mental trauma.

          Isn’t it it illegal to do that.

              Not exactly sure. Ideally this should amount to fraud.

              Lawyer here.

              1. Was the Job Offer unequivocally accepted by you? Did you complete any joining formalities?

              2. How was the Job Offer revoked? What were those reasons?

                  1. Yes the job offer was accepted by me. Joining did not happen as the founder is now finding reasons to say no.

                  2. Not revoked as of yet. But the founder has been avoiding me. He scheduled a telephonic call today. Till now, no sign.
                  He is mentioning trust issues and that I missed calling once after committing to call him.

                      Was the Job Offer and your Acceptance in writing?

                          Yes. Both the offer and the acceptance was in writing over Email.

                              That’s a Breach of Contract. You could do the following:

                              1. Send them an Email stating: unequivocal desire to join work; asking for formalities; joining date;

                              2. Failing which, a Legal Notice can be sent;

                              3. Failing which, a Civil Suit for Breach of Contract claiming lost pay, etc. can be filed.
