So yeah m a Delhi based lawyer and since past few days i have read multiples posts on this page where people are asking what to do in such situation where you are lending money to someone or now asking it backFew points:
1. No matter how close this person is, always take things in writing with their signatures that yes i, borrower is borrowing money from this person on this date and will be giving it back on this date etc etc
2. Take signed and post dated cheques from them, this will create a reminder bell in their mind as well that yes you have them and you can encash it and in the event of failure u can proceed legally
3. Make sure they write the content themselves
4. If hand written note is not possible, any sort of mail or text or whatever which can prove that they admit it without any pressure
5. If you are handing over cash, take receiving and yeah you can click picture as well
6. Money matters so do whatever u can do to collect evidence that u have given them money and they have to pay it back to you, you will need them if u r filing suit for recoveryNow if they are not paying back
Remember the points i have mentioned aboveSend them a legal notice ( indian postal service only) and give them a deadline, if they fail file a suit for recovery
Nd yeah dont throw that postal stamp
It is importantSo yeah thats a rough advice
