        I left my 2 BHK apartment in Metro city after 3 years and theandlordwants to deduct painting charges of 15k from.my deposit. This is not something specifically discussed till I left. The clause in my agreement says as below “That the Licensed premises shall only be used by the Licensee for Residential purpose. The Licensee shall maintain the said premises in its existing condition and damage, if any, caused to the said premises, the same shall be repaired by the Licensee at its own cost subject to normal wear and tear.” Nothing specific about painting charge is mentioned in agreement. Do I have to pay the painting charges. Request your help lawyers.

          1 month rent even for a 1 year stay for painting charges is standard in Bangalore. I’d say pay and move on

              You move in and you move out by next month, you still gotta pay in blr😆

              Blr landlords are crazy tbh.

                  I paid like this within 10 months of moving out. The paint was fully brand new, completely unblemished. My psycho landlord not only deducted, but also got it actually repainted for no reason

                      Painting cost much less if there’s not much to do so when the new tenants come, he will exploit them the same way. Overall he’s left w more but don’t worry karma is a bitch and they prolly gonna spend 10x more on some other emergency which will rise out of nowhere cause they exploited someone else, this is the way of nature.

                    I was lucky in this regard when I moved out of Bangalore. Stayed for 1 year and landlord gave back the entire deposit.

                      Long time back I had agreement that on vacating, 8k is to be paid for paintings. While vacating, owner deducted 15k citing paint is expensive now. So that’d bangalore owners for you.

                        I negotiated to a smaller amount and decided to pay partially with landlord since we had good record of paying rents on time and no complaints from society about us

                        I am not a lawyer but “maintained the premises in its existing condition” .. So when he gave you the flat its must be newly painted & obviously after 3 years the paint would have been deteriorated . So he expects rhe flat in same condition as when he gave it to you

                            Subject to normal wear and tear

                            Unless OP deliberately scrapped off some paint, some deteriorating paint is normal wear and tear.

                            If OP wants, this can be fought in court, but is it worth the hassle to save ₹15k, thats for OP to decide.

                            Yes. Pay it and get done with it. It’s usual even in Bombay. You stayed in the house and used it.

                              Was it newly painted when you moved in? If yes then yes, if no then no.. 🤷🏻‍♀️

                                  That’s what the advance is for and why wouldn’t u want to pay it? The painting detorriated during your stay and to attract new tenants he has to make sure it’s fresh and new as it was before u moved in so of course itll come out off your advance.. Now instead of letting him do the work ans thn ask u for the bill amount u could have told him that u will get the painting job done by your painters in his presence and once done he could return the entire advance amount

                                    If landlord had painted before you moved in then it’s the least you could do when you vacate.

                                        If this is Bangalore, it’s standard one month rent for painting. Doesn’t matter if your rent is 50k and you offer to paint it before moving out.

                                            3 years then yes. The walls are supposed to be maintained by the tenants. Another option, you could find a painter yourself and paid him to do the walls. These things are self explanatory.

                                              Find a replacement and transfer lease or rent agreement on their name. I have seen many people do this, the landlord will ask for 1 month rent when completely vacant but if you find a replacement you will save money on that. Do a fd post or reddit post and someone might replace you.

                                                Not much to read into it.

                                                Although you can try your luck and serve him a legal notice. Some landlords do end up paying so no harm in trying.

                                                  This is why I always agree with the landlord while taking a flat that I’d take pictures at the time of taking possession. If there is any damage that is visible in photos taken while leaving the flat then I’d pay, otherwise I will not. I get it added to the agreement as well.

                                                    Rents are so high that every tenant wants a repainted house.

                                                    No one is going to pay 70k to 90k for a house with even a slight blemish.

                                                    So they paint it before every new tenant moves in.

                                                    I once saw an NRIs house, never occupied, still got it painted when they decided to rent it out.

                                                    If the house was 10k to 15k rent, then it’s unlikely it will be painted. But anything above 30k is painted.

                                                      Tenant broke 90k balcony sliding door frame, but we deducted only one month rent as per the agreement.

                                                        Bro! Their TOS changes very often. Herr are few TOS my landowner: 

                                                        1. 3 months notice period 
                                                        2. 1 month rent for painting 
                                                        3. Cleaning charges 
                                                        4. Charges for any damages
                                                        5. 30 paisa per liter (water)
                                                        6. Min 10 – 15% rent increment every

                                                          Am going to rent my house and am painting for my tenant. If they stay for more than 2 years and vacate, we do collect painting charges.

                                                          Am also a tenant and my landlord painted before we moved in. He is collecting 20k for painting when I move out. So it’s normal.

                                                            Yes. Painting charges is a scam that is so normalised in metro cities. my landlord deducted 25k for painting charges for 2bhk even though the paint was neat and clean.

                                                            Don’t bother yourself. you’re lucky your landlord is even returning some part of ur deposit

                                                            My previous landlord took all the money by saying I’m vacating before agreeing so i have to pay rent till the agreement period even if i vacate.
