        Hi There,

        I live in Bangalore and have lived in the same flat for almost 30 months as of today. I told my landlord last month that I’ll vacate the place and he said okay.

        Background on rent agreement:

        Aug’22 to June’23 -> Had a rent agreement to pay 13500/- rent/month -> Deposit: 20k and 5% increment

        July’23 to Nov’23 -> no agreement was there and verbally discussed that the rent would be the same, so I was paying the same rent 13500/-

        Dec’23 to Oct’24 -> In Dec’23, the owner told me that he was going to increase the rent to 17k so If I wanted I can vacate the house or I can increase the deposit to total of 3 lakhs and stay here on same rent. So I did the same and we created a new agreement with 3 lakhs deposit and rent 13500/- and 5% increase after 11 months.

        I asked him couple of days back how much I’ll get back from my deposit at that point he said that 5% increment is there and I didn’t pay it so he will deduct the amount from the deposit for 19 months so a total of 32k I’ve to pay him extra.

        It was never agreed upon and he is not listening and challenging me to go to court or police if I don’t agree.

        I told him that for 22 months we’ve agreement to pay only 13500 rent, so I can give for 8 months but he doesn’t want to listen, just behaving rudely and not even talking to me or letting me involve my other neighbors.

        Could anyone please suggest what can I do here?

          If it’s not documented, it never happened. He can take you to court and he will probably win.

          Since you owe him money as him you can stay few days / months extra to recover your amount. Let the fight continue till that time.

              Thanks for the reply.

              But for 22 Months(2 different agreements) I had agreements to pay only 13500 and it’s not mentioned in the agreement that we are going to consider the 5% increase of previous year because I paid him 3 lakhs. its all in written.

              Can’t I do anything?

                  In true sense he should pay back your amount and is being an ass, consult some lawyer friend. I think I am not the right person to provide correct guidance on this further.

                  Will follow the thread if somebody provides a legal recourse. ๐Ÿ™‚

                banglore renting system is crazy , never faced aisa kuch delhi m , security and all is also rare .

                    August to June 23 agreement has written 5% increment and renewal right ?

                    You had no agreement for 11 months from July 23 onwards. So he would have consulted someone if old agreement is enforceable.

                    Also are you ready to take him to court for this amount? And suffer yourself in the process?
